EduAbility AI is operated by Ediscovertek Solution LLP, a limited liability partnership registered in India ("we", "us"). When you use EduAbility AI you are contracting with Ediscovertek Solution LLP.

1. Acceptance

By creating an account or continuing to use EduAbility AI, you agree to these terms. If you use it for a school or organisation, you confirm you have authority to bind it; individuals must be of legal age.

2. The service

EduAbility AI helps educators and families create individualized education programs, support plans, matching cards and related learning materials using AI. We grant you a limited, non-exclusive, non-transferable right to use the service within your plan.

3. Your account

Keep your login details confidential and your information accurate. You are responsible for activity under your account.

4. Acceptable use

You must not misuse the service, including:

5. AI-generated content

You are responsible for the information you enter, for having the right to share it (including consent for student information), and for how you use outputs. AI outputs may be inaccurate or incomplete. They are drafts to support professionals and are not medical, clinical, diagnostic or legal advice; a qualified educator or therapist must review them before use. You own your inputs and, as between us, the outputs you generate. We may remove or restrict content, filter outputs or suspend accounts that break these terms. Rights-holders can report infringing content to us and we will act on valid reports; repeated infringement leads to termination.

6. Your content

You give us a limited licence to host and process your content only to provide the service.

7. Our intellectual property

We own the service, its software, documentation and branding.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, renewal, cancellation and refund terms are set out in Paddle's Buyer Terms. See also our Refund Policy.

9. Service level and warranties

We do not guarantee the service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Liability

Our total liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential losses such as lost profits, data or goodwill. Nothing limits liability for fraud, death or personal injury where the law does not allow it.

11. Indemnity

You will indemnify us against claims arising from your content, unlawful use or breach of these terms.

12. Suspension and termination

We may suspend or end your access for material breach, non-payment, security or fraud risk, or repeated or serious violations. When access ends, you may ask us to export your data within 30 days, after which it may be deleted.

13. General

These terms are governed by the laws of India, and the courts of India have jurisdiction. You may not assign these terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
